Mainly because one juror couldn't figure out if having sex with a woman who was blacking out during the ordeal was rape or not.
One juror said they watched the surveillance video of the incident 100 times and he said he was leaning guilty but there was too much reasonable doubt as to consent.
"Blurry images … you really couldn't tell heads or tails what was going on so it made it very difficult," the juror says.
Prosecutors alleged that the pair sexually abused the woman, who was intoxicated and lost consciousness at least once during the alleged incident.
This is going to be held up by some people as a "false" rape case, where the two men were found "innocent." These men were not found to be innocent. The jury just couldn't come to an agreement, because what constitutes consent is still a grey area for far too many people, like it is for this juror.
For many others this will be a chilling reminder that even if a rape victim is willing to testify in court, the rape is caught on video, and the victim is immediately tended to by doctors, rapists still walk free - because there are people in this world who truly do not understand exactly what rape is.
Sex with someone who is too intoxicated to stand, speak, or say "no" or "yes" is rape. Period. One day, these two scumbags will get theirs. Just not today.
I wish justice could have been done for the victim. I truly hope that she is able to put this incident behind her and doesn't let the scars of this experience dictate how the rest of her life will be.
