War Machine explains what happenned and asks for support
Hi everyone, wishing you great Sunday.
I have just read the message of War Machine to the fans, on what really happenned and I believe him. So, i have decided to post his message here. If any of you feels so, please support him because this is a total mistreatment and I don't even understand how could anything like this happen. People who change should get a chance and not sent back to prison to waste time there, while they could be working, fighting and living. So, please read it and please support War Machine.
Here is the full letter:
"The reason I am upset with having to do time this time is because this event occurred over 3 years ago and I am not the same person today. I went on a lil' rampage for a few years and made a lot of poor choices...it finally all caught up to me last year and I served a year straight in San Diego County Jail. During that year I had a lot of time to think and realize I needed to change. Upon my release over 6 months I did just that. I have been attending my anger management classes, staying away from the party scene and booze. I have been teaching Kid's MMA Classes and living life the right way. In my professional career I won the biggest fight of my life vs Roger Huerta and became only the 2nd man to ever finish him. I recently signed a contract with @BellatorMMA and had a chance at winning over a 100k in their tournament, a tournament that I will now not be participating in. Of all the things I have ever gotten in trouble for this one is the dumbest one. The person I fought was a coworker of mine 6'2'' and over 300lbs. He instigated the fight, he came after me. I punched him ONCE and then took him down. During the takedown he injured his knee. The reason this case had been dragging on so long in the court system is because the DA's office had a WEAK case and my attorney and him were constantly negotiating for a plea bargain. Upon my release from jail I told my attorney that I wanted to get this case over with and get on with my life, put the bs behind me. I agreed to pay a huge fine of $61,000 for his medical bills and signed an agreement for probation and NO JAIL TIME. The DA and myself were both happy with the agreement. 3 weeks after I plead guilty I returned to be sentenced and the Judge Valerie Adair completely disregarded the DA and I's deal, as well as the progress I have made since being incarcerated and learning my lesson and CHANGING. That was an irresponsible decision on her part. Jail is supposed to be a tool to rehabilitate people and rehabilitation had taken place! WHy would you mess that inertia up? Why not give me a suspended sentence and a chance to continue proving myself? She scolded me and accused me of using steroids, I have NEVER tested positive for them or had an arrest for them in my life! She judged a book by it's cover and that is not just! I deserve to stay free and continue to prove that I am a changed man! Write the Governor and help me! http://gov.nv.gov/contact/governor/"

That would be extremely unprofessional if the judge really brought up steroids during the hearing.

I have no idea how much power can a judge have on someone who is just under probation.. but i know probation is a very sensitive state… i m just sorry for him because he is a good guy . this is just so unnecessary and so bad. I have no idea what can anyone do but i hope fans will write to the governor .. maybe some can save this case. He is a good fighter who just restarted. Now back in jail… who knows but if i were in the same situation i know it would really suck..

and that was an extremely eloquent for a WM written piece. I also don’t understand the judge’s disregarding the plea deal that was struck, in order to just “stick it to him”. The victim in this case had already ok’d the deal with WM, why are you stepping in. That actually pisses me off, goes into the Prison- rehabilitation vs. excessive punishment, argument

I am really starting to think that WM really has changed for the better. This really sucks that a judge just thinks it is in her authority to completely disregard anything that has already happened, and really unprofessional.

He’s saying that he was accused of using steroids by the judge, when there’s no REAL basis(such as as positive test or arrest) for such.

not that peculiar, when you are dealing with a legal situation, lying is bad. You also shouldn’t say anything more than you have to. Saying he’s never tested positive or been arrested is smart because it’s truthful, and no one can come up with anything to turn that into a lie. If he says he never used steroids, someone can come up and say that they saw him use, and whether or not that is true it would hurt him.
Right. I understand the rationale behind wording it like that, but it can definitely lead to statements like the one above. It makes it sound like he has done steroids before, but just hasn’t been caught. And he has been an advocate of them in the past.

He has stated several times that he doesnt understand all the hassle about roids. Yet i dont think he does that nowadays .. he was heavily on diet and just trained.. it will be pretty hard to start over.. in this case prison is just a big timewasting and absolutely bad

He should have released this earlier. It seemed (to me anyway) that he had just ignored the issue in Vegas and was hoping it went away. It sucks that he got locked up when he thought he had a plea deal. Unfortunately, that can happen sometimes, since the judge sets the sentence.
Hopefully the ridiculous comments on steroids can help him out with an appeal.

bummer for the dude,
but this has nothing to do with why he was in jail before. i’m not saying that WM is being insincere here, but everyone is contrite when they first get out of jail. all of the people that i know that have gotten DUI’s always claim, after getting out of jail, that they will never drink and drive again. that only lasts until the first time that they drive themselves to a bar.

the incident he’s referring to happened BEFORE the one he was sent to jail for. He didn’t something, did something else, went to jail, is attempting to improve himself. His crazy actions culminated in his last incident, which led to jail time. He had already worked out an arrangement that the victim, the DA, his lawyer, and himself were comfortable with. This jail sentence serves zero purpose, as I’m assuming now the victim is also out money, as the arrangement was scrapped due to the judge

but is this not the same man who being very close to release, or just out of jail tweeted that he needed to move to a “less civilized society, where he could fight to be the top dog, in a land not ruled by bureaucrats as it is here” rehabbed my ass, hes still the same guy, just because he has been distanced by his babysitters does not mean hes changed, what happens when no one is around to babysit him?

what I'm wondering is
since he had a deal worked out with the victim to pay his medical bills etc etc, but the judge tossed that deal, does the victim now get nothing? It seems that this situation is troublesome for multiple reasons. If that is the case, in her push to punish WM, the judge has screwed the other person over as well

I agree with him on this one.
He has had a volatile life and he is trying to get it straight and it sound like he was doing well. Throwing him in Jail right now is just stupid especially since he had a deal arraigned and that’s why he plead guilty. He could come out and set back down the wrong path.

and he really is a reformed man the first thing I’d be telling him is to change his fucking name back to something less ridiculous.
Seriously, imagine you’re a judge; you’ve got some dude who comes in on an assault charge, he’s got a history of violent offences, he’s covered in stupid hand-grenade tattoos and he’s telling you that he’s a new guy and that society would be a better place with him a free man.
What’s his name? Oh, its Mr War Machine! Yeah- you’d give that guy a lenient sentence for sure. Clearly that guy had a deep respect for society when he’s clearly happy to have a name which means that every single respectable person he ever meets will instantly think that he’s a complete tool.
I don’t know the dude, he might be the nicest guy ever, but you can’t possibly be surprised that the judge doesn’t believe you’re not a violent person when you’ve changed your name to imply you’re a machine of violence.

I’m pretty sure it’s ok if you have it as a nickname, so if it was Jon "War Machine" Copenhaver (or whatever it is) it would be fine.
The issue was that he was billing himself as ‘War Machine’ all the time and using it as a brand, as opposed to just being himself and having a nickname.
I mean heaps of fighters share/ steal names all the time and its cool. Kurt ‘Batman’ Pellegrino never had a problem for example, but if he was advertising fights as George Sotiropoulos vs Batman then that would probably be an issue (and awesome).
The point is 99% of people don’t watch MMA and will think that only a violent idiot would change their name to War Machine. Even of that 1% that do, the vast majority of us are intelligent enough to understand that there will be a social stigma attached to you if you call yourself that, and wouldn’t be surprised if a judge showed you less leniency.

If the judge is punishing him for being unconventional, then that judge has no business on the bench.
I don't get it.
If he signed an official plea deal, then his lawyer has all he needs to start a suit of his own against the state.

The Justice System
Is supposed to punish the convicted, rehablilitate the offender so that they can be a productive part of society, and deter the convicted and would be criminals from comitting crime.
Most people just get hung up on the punishment aspect, because fuck criminals, but a good jailing system should aim to do all three.

As for the judge, however innapropriate they may be, it does not excuse you from your crime.
As for the DA, it is a sentencing reccomendation, the judge has no obligation to go along with it. Yes, these instance are unusual, but it is the judges perogative.
And no, i’m not an attorney, but i do watch Judge Judy and i stayed at a Holiday Inn Express last night.

Yeah I've been a Paralegal for about 8 or 9 years now and am taking classes to prepare me for law school.....
I see this type of thing a lot. A judge has full sentencing discretion but typically will side with the prosecutor if a plea agreement is arranged. However, put yourself in the judge’s seat. This is a case that was dragging on, followed by a hurried plea agreement, between a prosecutor who obviously had trouble completing their case (hence the quick plea agreement) and a guy named War Machine who has served time for multiple violent offenses. His having served time for DIFFERENT charges is completely irrelevant. He can plead for leniency, and use his rehabilitation items he listed for help, but the judge doesn’t owe him anything and feels he should be punished for what he did….. she doesn’t have to accept his time served on other charges as payment to society on these other charges.
