Former UFC Title Challenger Hermes Franca Sentenced to Over Three Years in Jail

Former UFC lightweight title challenger Hermes Franca was sentenced to three and a half years in jail yesterday for sexual abuse of an underage student. The original charges were seven counts of sexual abuse and two counts of unlawful sexual penetration but a guilty plea got those charges reduced to one count of each.
Hermes Franca Barros, 37, pleaded guilty in Clackamas County Court on Wednesday to one count of unlawful penetration and one count of first-degree sexual abuse. He was sentenced to 3½ years in prison.
He was arraigned in May on seven counts of first-degree sexual abuse and two counts of second-degree unlawful sexual penetration. The remaining counts were dismissed.
Barros will also have four and a half years of post-prison supervision and must register as a sex offender.
Barros, a resident of Jupiter, Fla., turned himself in to Clackamas County Sheriff's Deputies in May after a warrant was issued for his arrest, stemming from a December 2010 encounter with one of his students.
I'll refrain from any comment here as I don't have any more details, but it's been a very quick decline for Franca since getting his title challenge.

That's his maximum sentence
Even as it’s “Criminal Sexual Misconduct” it’s unlikely he’ll serve the full term, most likely being out at 60% of his sentence. Unless that’s his minimum, but they usually talk about the max because it’s more dramatic.

once you’ve earned enough abatement time that would be equal to you getting out after 85% of your sentence, you aren’t allowed to earn anymore days. So he’ll end up doing no less than 3yrs

My wife is a parole officer for sex offenders.
She said he’ll have Lifetime Probation, too. After he gets out and he’s on parole, he won’t be allowed to have contact with any minors including members of his own family and he won’t be able to go any business whose primary customers are children like arcades, fairs, pizza places, amusement parks. He’ll also have to register as a sex offender and notices will be sent out to whatever neighborhood he paroles to describing the crime he was convicted of. He won’t be able to parole to an address in the vicinity of a school either.

I’m a CJ major and my last instructor was a Parole/probation officer for the state of Michigan. He only monitors sex offenders/felony probationers.
It’s what Franca deserves.

Just a question
and I know it’s a stupid one. But if he has kids (don’t know if he does) or if he one day has kids, how is that impacted? Does he have to stay away from their schools/parks etc?

yeah in michigan it's different as well
they have “Truth in Sentencing” laws that stop criminals from leaving too early, it just depends on the sentencing guidelines on what the minimum is. Every state is different

The victim, Samantha Geimer, during a television interview on 10 March 2011, blames the media, reporters, the court, and the judge for causing “way more damage to [her] and her family than anything Roman Polanski has ever done.”
But this sounds to me like she wanted it also and maybe he didn’t know her age.

I know of people who have done serious favors for him and he stabbed them in the back by ripping them off of thousands of dollars.

He’s going to be making extensive use of his fighting skills in prison. Sex offenders don’t generally have a good time inside.

‘Fair’ fights are pretty rare in prison.
It is far more likely he’ll get cornered in the shower by a group of guys or take a shiv in the kidney while he is chillin’ in the yard.

My brother was in the prison he likely go to for 12 years and I can tell you its not like that.
Maybe in San Quentin. Not around here.
Throw in the fact the he really could cripple damn near person there for life, odds are he’ll get fucked with once or twice before people stay away from him.
