Joe Son Found Guilty of Torture Charge Stemming From 1990 Rape

Photo

There was a time for MMA fans when the mention of Joe Son would be met with laughter and either a mention of his being repeatedly punched in the groin by Keith Hackney at UFC 4 or showing up in an animal print thong at a PRIDE event. A turn as Random Task in the first Austin Powers movie further endeared him to many fans.

The Joe Son saga has taken a very dark turn in recent years though. After being arrested for an unrelated charge, a DNA sample taken from Joe matched DNA collected at the scene of a gang rape which took place Christmas Eve of 1990. Last week he was found guilty of the charges, and now faces a max sentence of 15 years-to-life. E! Online has the very disturbing details:

The rape occurred on Dec. 24, 1990 at approximately 12:30 a.m. when the unidentified victim was walking back to her apartment alone with her dog after going to look at Christmas lights with a relative and friend.

Per the Orange County District Attorney's Office, Son distracted the woman by asking for directions and pretending he was lost. Son and co-defendant, Santiago Gaitan, then dragged her to their car and threw her in the back. After pistol whipping her and telling her they were driving to Compton, the men instead drove to Huntington Beach where they raped her repeatedly, sodomized her and forced her to give them oral sex.

The D.A. also stated that Son also threatened to kill her, penetrated her vagina with a firearm, and counted the bullets in the gun out loud while the victim pleaded for her life.

Unfortunately, the statute of limitations on the rape and forcible sodomy charges passed which forced the prosecution to only pursue torture and conspiracy to commit murder. He was found guilty on the torture chare.

this may be a really dumb question

But what exactly does this

Unfortunately, the statute of limitations on the rape and forcible sodomy charges passed

mean?

Thanks.

That seems like a really stupid thing. Reading what he did he should def be getting charged for both who cares how long ago it was.

No problem

Agreed. I’m surprised there’s a statute of limitations for rape and forcibly sodomy at all.

by Damnatio Memoriae on Aug 30, 2011 11:05 AM EDT up reply actions

It exists for a few reasons..

DNA can degrade over time and will become unreliable, amongst other things. There is a reason it exists and it’s a very good set of reasons.

If you care about innocent people staying out of jail

Then you can be damn sure they are good. Witnesses memories in particular are easy to manipulate over time, memory fades and changes. Victims don’t have to worry about getting dragged into a legal battle over something they would prefer to move on from decades later. Police forces can’t use the lack of prosecution of a minor offense as a threat over the head of the accused, especially if it means they are given effective carte blanche on running over the accused rights. Plus people will clog up the system over petty crimes when it should be providing closure for real victims.

Crimes such as this also have loopholes. Sexual assault covers a variety of crimes, and is thus not considered heinous, the ones that are horrifying like this one can usually be chalked up to different charges anyway. The justice system is pretty flexible with stuff like that.

Statute of limitations is the maximum number of years that is allowed to pass before someone can no longer be charged for a crime.

It is like if someone attacked a person and they died 2 years later from one of the injuries the person caused, then they could be charged with murder. However, if they died 40 years later then the person couldn’t be charged because the statute of limitation has passed.

I was not aware there was a statute of limitations on rape. that is BS. This dude is a grade a piece of garbage. Anyone that would do that to someone deserves the death penalty IMO.

Giving him a life sentence is a better punishment than the death penalty in my opinion.

Dude’s gonna die in prison.
Most death row guys spend a few years in prison before their execution anyway.
Either way, best to keep this guy off the streets.

Just awful.

Agreed on Death penalty thing.

Costs to much to keep him in prison. And what he did is absolutely ridiculous. The last part about counting bullets in the gun is just infuriating that someone would actually do

The average length of time for a death row inmate to be executed is over a decade.

by Strikeboxer on Aug 30, 2011 11:13 AM EDT up reply actions

Yea, it’s actually much more expensive to put someone on death row. I am not looking at the numbers right now, but I think I remember the average length of time on death row is like 18 years and it costs around 3 million dollars with the 3 appeals they are allowed, and it only costs 750k to put someone in jail for life.

I think the statute of limitations in rape came into play before DNA evidence existed.

I think the idea was that testimony might be cloudy. Given how long it often take victims to disclose what happened, this is complete BS.

I mean if I am a wealthy business man and I raped somebody 20 years ago, it is obviously a flaw in the legal system if somebody charges me right

When there is honest to goodness proof of something like this, there should be no statute of limitations.

Thankfully we have the means to spend much more per year feeding and keeping these dirtbags healthy instead of feeding starving children or providing help and free care for homeless people. Definitely money well spent.

So the fact that there is a statute of limitations on it and not torture is ridiculous. These laws have to be updated to keep up with science.

I’m sorry, but this shit pisses me off. Rape/rapist are horrible, horrible people to me. They’re some of the worst pieces of shit on Earth. I watch that show To Catch a Predator, and this may sound fucked up, but I would much rather my 13 year old daughter be a complete dumbass and voluntarily invite a predator into her bedroom than one showing up unannounced.

A film where people can die in the making, or horrible things happen to them in reality? Pretty sure they wouldn’t allow that in blockbuster.
