Josh Barnett Unlicensed in Texas, Strikeforce: Overeem vs Werdum Only 10 Days Out

Bloody Elbow has confirmed Strikeforce heavyweight Josh Barnett, who is scheduled to fight on the Strikeforce: Overeem vs Werdum card in Dallas on June 18, has not yet been licensed to fight in Texas. Barnett is booked to face Brett Rogers in the second installment of the first round of the Strikeforce Heavyweight Grand Prix. 

Yesterday, Strikeforce CEO Scott Coker assured the media that Barnett would be licensed in time for the fight. According to Susan Stanford, Public Information Officer for the Texas Department of Licensing and Regulation, Barnett has until 72 hours before fight time to complete his application, but has not yet done so.

Earlier today Stanford told Bloody Elbow that "Mr Barnett's application is incomplete."

She declined to state what additional materials Barnett needs to submit to complete the application, but she did confirm that he has submitted some materials to begin the application process.

Ominously, Stanford also indicated that Texas authorities would weigh Barnett's status with the California State Athletic Commission when deciding whether or not to license him to fight. 

Barnett infamously failed a drug test administered by the CSAC in 2009, forcing the cancellation of his Affliction bout with Fedor Emelianenko. That entire card was cancelled when Barnett could not be licensed in California. Barnett had to wait a full year before re-applying in California but after several botched attempts, post-poned and missed hearings, Barnett abandoned his attempts to be licensed in that state altogether.

George Dodd, Executive Officer of the California State Athletic Commission, indicated that in order for a fighter to obtain licensure in the State of California, he or she must request a hearing and appear in front of a committee. Barnett has not requested any such hearing, and the next scheduled meeting of the CSAC is slated to take place on June 20, two days after the scheduled Strikeforce event.

Texas has a bit of a reputation as a lax licensing state. Most notoriously they allowed Antonio Margarito to face Manny Pacquiao in a big money PPV main event held in Cowboys Stadium after Margarito had been stripped of his license in California for allegedly attempting to plaster his hand wraps for a bout against Shane Mosley in January 2009.

Regarding Margarito, Texas authorities referenced a statement issued by the Association of Boxing Commission in advance of the Pacquiao fight saying, that because "Mr. Margarito has fulfilled his obligations per the ABC (which was to appear before the CSAC before applying for licensure to another state/tribal commission in the United States) and thus he is now free to pursue licensure with any ABC member commission." Even though the CSAC denied Margarito at that hearing, his appearance gave the ABC (a notoriously flexible and accommodating body) and Texas authorities the necessary fig leaf to approve the lucrative Pacquiao-Margarito bout. 

Barnett did appear in front of the CSAC early this year, but he withdrew his application mid-hearing and would not meet that precedent. 

The 2009 test failure was the third time Barnett had failed a drug test. He was stripped of the UFC heavyweight title in 2002 after testing positive for for three anabolic agents; Boldenone metabolite, Fluoxymesterone metabolite and Nandrolone metabolite after his UFC 36 bout with Randy Couture. He had previously failed a non-binding provisional drug test administered by the NSAC.

After leaving the UFC, Barnett fought for most of the 2000's in Japan, both MMA (for Pride Fighting Championships and Sengoku) and as a pro-wrestler. Barnett successfully passed drug tests while fighting twice for the Affliction promotion in 2008 and 2009 before failing the test in advance of Affliction III.

UPDATE 2: Sergio Hernandez of MMA Mania reports that he has contacted Susan Stanford and she said:

Of the 16 fighters scheduled to compete, they have 9 completed applications and 7 incomplete applications.

UPDATE 3: MMA Junkie spoke to the Susan Stanford later in the day:

Stanford said Barnett's history in California is not a factor in his application for licensure in Texas because the fighter is not currently under administrative suspension on a registry of fighters maintained by the Association of Boxing Commissions.

When I spoke to her she indicated Texas would weight Barnett's status IF he was in the ABC data base. Apparently she checked.

So…Barnett still has the opportunity to get licensed in Texas by Zuffa, but Chael will be shelved? Perhaps this is what Dana was actually referring to when he said “business as usual”?

But personally, I’d prefer to see Cormier in there. He’s been talked about as this great prospect for so long now, I want to see him take a big step up in competition.

Yeah, I think Griggs too. It seems like they were seeded with Del Rosario being #1, I would guess Griggs is #2 and Valentijn #3. If anything stopped Barnett from participating, and I doubt he will have any issues at the end of the day, we would get Griggs v Rogers and Valentijn vs Cormier.

he’s not headlining, he’s not the biggest star, and this is a pretty stacked card with more heft and weight to it. this is Texas we’re talking about, so i’m sure it’ll get straightened out, especially if he’s not the only one pending approval.

Does Barnett even want to fight in the U.S. anymore? He should just give up being an MMA fighter because if he can’t get licensed in Texas, then he won’t get licensed anywhere in the U.S. with the exception being if he fights in an Indian Reservation.

That makes sense to a certain point

But Josh displayed no real interest in resolving the CA license issue while Strikeforce was still helmed by the extremely accommodating Scott Coker. Now that he’s a Zuffa contractor with a scheduled fight in 10 days he’s still not licensed in Texas, a state with demonstrated licensing flexibility. He’s had 2 separate chances to get himself back on track and the second one is almost expired. So the question needs to be asked, does he honestly give a fuck about competing in MMA anymore? Unless he likes what MFC, Titan, Sharkfights etc. are paying, this is his last chance.

He resolved the California issue. I’m thinking his attorneys considered it better to not have a license in California than to be denied license in California, in which situation other states would follow suit and deny license.

His history is that of someone who has constantly blamed Zuffa

for all his issues. He never owns up to anything. When he was busted the second time after defeating Couture, he blamed Zuffa and said they were setting him up. He’s held onto a grudge and despite being employed by Zuffa owned Strikeforce, that doesn’t change the fact that he’s not a fan of Zuffa at all.

Josh was being “set up” in that they didn’t publicize the results of his first failed drug test (and didn’t even notify him depending which story you believe) until he asked for more money following the destruction of the marquee champion Randy. The UFC used his failed drug tests in bad faith to damage his public profile in hopes of signing him for less money.

He should have a license in hand already, it’s 10 days away. He’s done a half ass job caring about getting square with the CSAC (which does influence other commissions) and this is just another indifferent approach from him it seems.

I am surprised though to hear the news, and hopefully the incomplete app is indeed just a minor clerical issue.

While I normally agree with that, it’s right in the article that he’s in the process of applying. People are going to blow this out of proportion because it’s Josh Barnett. This is just one of those times (to me) where we can whip the pitchforks out when we know what the deal is, but doing it now seems pretty premature.

I agree. My main point was that he should’ve done all of this stuff weeks, if not months, ago. But I agree with you that maybe, just maybe, he’s got valid reasons for not doing this before. But then again, does Barnett really deserve to get our benefit of the doubt? It’s not like he has never pulled crap like this before, is it.

We have no idea what is “incomplete” about his application. It could be almost anything, from the most trivial checking of a box to something major and almost impossible to complete in time.

But BM is right. It might be something on Texas’ end and maybe half the card isn’t licensed yet. It just so happens that Barnett’s case kicks up the most dust.

But if it comes back that most, nearly all, or every fighter has dotted the I’s and crossed their T’s but Barnett hasn’t, it won’t look good for him.

It also says they’ll weigh the CA ruling during their review. Given his history and previous interactions with athletic commissions, I think avoiding last minute scrambles may be advisable in this circumstance.

He had good wins at both Affliction events. KOing Rizzo in a rematch and making Gilbert Yvel tap to strikes. Neither guy was top 10, but Josh looked better than ever.

It does say that he has submitted something but needs to submit more. It’s not like he’s ignored it entirely. It’s possible that he accidentally left part of it incomplete(happens to the best of us) or that, given his situation, the commission wants additional materials from him. For all we know, he submitted everything he thought he needed to and the commission has requested more from him.

I would hope that this late in the game that it’s just a missing signature or last second physical that is missing. I wondered if texas would just rubber stamp him while he was still in limbo with CA (they approved Margarito after CA officially said no)

It would be shady for them to know he’s applying for a while and then use CA as a reason to deny him at this point in time, but if they do that, I will still hold him and Zuffaforce responsible for letting this sit for this long. Who knows why he is one of the 7 incompletes instead of the 9 completed applications, but with his history, the t’s should have been crossed and i’s dotted a long time ago.

Godamn it, if he doesn't get licensed he should retire.

I’m a huge Barnett fan and I think he can atleast hit the GP finals, what i’m not a huge fan of is his procrastination, maybe this article will teach him a lesson to be more proactive about licensing his career.

I thought the fact Margarito fought made it a forgone conclusion that Josh will get to fight. If they’re being fair it is, at least. Personally I don’t think steroids are a big deal but I’ve learned to keep my opinions of drugs to myself. Either way it’s not in the same universe as plastering your gloves.
