Chael Sonnen Friend Still Believes Chael Sonnen Punished Unfairly

Last week, I introduced you to Marika Taylor, host of the revered "Outside the Ring" documentary show. At Chael Sonnen's May 18 hearing with the California State Athletic Commission, Ms. Taylor answered the commissions call for open discussion, giving an impassioned speech in Sonnen's defense. Thereafter, she took to Twitter and Mauro Ranallo's radio show to blast the CSAC, threatening to "have it dismantled" in the process.

It's worth pointing out that Ms. Taylor's objectivity may be clouded by, you know, being his friend.

Fortunately for us (or me, in any case), she's back with more Twitter goodness. My favorites:

While Kizer and CSACs plot to end Chaels career entirely was intercepted, they still managed to keep him from making a living on TUF.

It would be great if Kizer and George Dodd played modern-day Randolph and Mortimer Duke, conspiring to ruin the once-pristine Chael Sonnen while resurrecting the troubled career of Josh Barnett. All over a bet for a single dollar bill.

I hope Chael sues the CSAC and includes Kizer in the lawsuit since he orchestrated the plan and got the CSAC to carry out his dirty work.

No word on whether the CSAC called the real cops on a frat party, spliced gay porn into Men in Black, or put a bunch of dead hookers in the trunk of Sonnen's car.

Don't understand what CSAC stood to gain by carrying out Kizer wishes or why Kizer has such a hard on for Chael. But I'll expose everything

Chael had already resolved his issues with CSAC and had served his suspension for what CSAC believed was improper disclosure of medication

Chael only disclosed his use of testosterone-replacement therapy after he believed that USADA was running or assisting with the testing procedures. And then he popped for elevated levels of testosterone anyway, making the whole point moot.

At the Hearing last Wednesday Kizer swore under oath. Actually he instead of saying so help me God Kizer arrogantly said "so help Me"

The arrogance! Refusing to swear on a deity that has no place in state business.

Kizer is childish, petty and unprofessional. He's an attention whore.

Kizer prevented Chael from making a living, defamed his character, disclosed a private medical condition publicly and is a disgrace to NSAC

Could Sonnen win that case? I’m no lawyer by any means, but if they can’t convict Sonnen on a perjury charge, then I’d think he could sue and possibly win.

Eh, it varies jurisdiction by jurisdiction

Historically, I believe that libel was written defamation, while slander was oral. In some jurisdictions, it’s all just defamation (which makes sense, since mass publications is now so often by radio, television, or internet video). Both are based on publication of defamatory statements to a third party, and just differ on the means of publication.

I should have bolded that line. :)
But if the standard punishment is 1 year for a failed drug test and Sonnen gets more than that, couldn’t he have a case against the commission? That’s why I brought up the perjury charge. If they don’t charge him for perjury then the only thing they’re punishing him for is a failed drug test. Couldn’t that be deemed unfair if he gets a longer sentence?

1. That’s why I brought up the fact that in order to punish him they have to convict him of perjury IMO.
2. No one to my knowledge in MMA has been suspended for a criminal act outside of the cage.

Chael was given 6 months by the CSAC

Later, if was made clear that he had lied to them about conversations with Kizer, among other things. They are punishing him for lying to them.

Perjury is incredibly hard to prove. I doubt he will face charges or be indicted. That doesn’t mean he’s not a liar. He has no case of any kind.

Either way, they’re totally allowed to punish him for lying if they believe he’s lying, regardless of whether or not they can prove beyond a reasonable doubt that he perjured himself.

That sounds like they’re punishing him for their own incompetence. They’re embarrassed and that’s why Chael is serving an indefinite suspension.

I still say that the only concrete thing they have on him is a failed drug test. He said he misspoke. Bullshit excuse or not they can’t prove he lied instead of misspoke. If in the hearing they upheld the previous conviction I would say CASAC did nothing wrong.

Its not a criminal case. He was obviously being dishonest, now he’s being punished for it. If they let him go now, it would be further proof of their incompetence.

Kizer says he’s free to apply in Nevada next month, who knows?

He’d technically be serving less than a year if they do that (if I remember all of the details). I don’t think it’d look much better if they license him in two months. I have a feeling Chael’s not fighting in the US until late 2012 or 2013.

Because if Chael applies at NSAC and is denied, I believe that denial works as an effective 1 year suspension and other jurisdictions would be unlikely to approve him for a license.

It’s why Josh Barnett ended up not applying for a license with CSAC when he thought it likely that CSAC would just deny his application, If he applies, maybe he gets approved, but probably he gets denied, making his attempts to be licensed in other jurisdictions more difficult. So why not just skip CSAC altogether and try your hand with another commission?

Who let’s a defendant introduce hearsay evidence and then takes him at his word? A bunch of incompetent boobs, that’s who.

The second Sonnen tried to use Kizer as an absentee witness, they should have nipped that shit in the bud. Or got Kizer on the phone. Or postponed the hearing until such time as Kizer could corroborate Sonnen’s version of events.

Sonnen never should have got his suspension reduced in the first place. That is what makes them incompetent.

There were so many fishy things going on about that doctor and Kizer said, in the media, days before the trial that he never talked to Sonnen about TRT and that Sonnen shouldn’t bring that up as part of his excuse. Why not investigate that claim? Why didn’t they ask Chael about what Kizer said at the hearing?
My feeling is that commission looked incompetent, felt embarrassed and is trying to get revenge.

And yes, he was outright lying, not misspeaking or any other naive nonsense. If you are getting on them for not using common sense before in not suspecting his claims, you should welcome the fact that they are using common sense in realizing he was bold faced lying.

(Not being a smartass, truley asking a question) Has anyone, in any league, minus Pete Rose, ever been suspended for lying? (Note: I acknowledge that Chael’s lie is hard to top)

What I’m trying to get at is: What’s the penalty for lying? Chael’s indefinite suspension is up next month. I find it hard to believe the commission would reinstate him next month. If they deny his request, he has to wait another year to re-apply. Does a 22 month suspension fit the crime? Maybe to some, but not to me.

Pretty unlikely

Any claim by Sonnen against the CSAC and/or Kizer would have to be based on an actionable wrong. What could he sue them for? Suspending him? He was given an opportunity to testify in his own defense, and the commission didn’t believe him. They are within their rights to disbelieve his testimony; as the finder of fact (just like a jury in a jury trial or judge in a bench trial), it’s the commission’s job to judge witnesses’ credibility. Whether or not they could prove that he perjured himself is an entirely separate question from whether he gave credible testimony. And what would he sue Kizer for? It couldn’t be for what he did in Nevada, because that’s Kizer’s job. And I can’t think of any reason off the top of my head that Kizer wouldn’t have been entirely within his rights to provide the CSAC with truthful statements about the Nevada’s decisions regarding Sonnen’s license and the reasons behind that decision. Maybe if he had lied to the CSAC about Sonnen to harm Sonnen’s professional repution, Sonnen might have a defamation claim, but the truth is always a defense, and there hasn’t been any suggestion that Kizer lied about anything. In other words, sucks to be Sonnen.

Sue worthy or not I think it’s unfair. As I said above, I’d have no problem had they said “He lied and we’re upholding the original suspension of one year.”, but they indefinitely suspended him instead. If he re-applies and is granted a license then I have no problem either, but if they deny him, then his suspension would end up being almost two years with no guarantee that they’d license him in the future.

It’s not like no one has lied in front of the commission before. How many times have we heard “I took a tainted supplement” or a handful of other excuses. Chael’s was more blatant. Take a look at all James Toney had to do to get off:

CASAC felt like they looked silly and took revenge. It isn’t about lying in front of the commission. If they had done a proper investigation or delayed the hearing until they could check out those claims then they wouldn’t have that problem to begin with.

“I took a tainted supplement” is highly unlikely, but it’s also not obviously a lie the way Chael lied. When it’s that obvious that you’ve been lied to, you have to take some action.

Chael has the same problem as most of the dirty politicians in history, in that they don’t understand that what gets them in huge trouble is not whatever thing they’re trying to cover up, but the cover-up itself.

If Chael had just gone in front of the commission and said “Yes, I lied. It was a terrible and stupid mistake and I know I shouldn’t have done it”, he probably would have gotten off with the remainder of his year’s suspension for steroids and then some nominal suspension for lying (say, add another 3-6 months). Instead, he went in front of a commission that knew he lied and proceeded to lie about not lying, at which point he crossed over from “someone who told a lie to the commission”, which would be bad but not fatal, into someone whose words are wholly untrustworthy.

And the Toney thing is inexcusably bad, but CSAC is trying to clean up their shop. If Toney’s behavior is an excuse to let Chael off the hook and not doing so is somehow unjust, then CSAC will never be allowed to clean up their shop. Because if that’s the case, the next person to get suspended will just point at Chael, and the next person will point at the previous person, and at no point can the commission ever make a break from their past misdeeds without being “unjust” to some individual.

Chael also said he misspoke regarding talking to Kizer. As bullshit of an answer as that is it can’t be disproven any more than “I took a tainted supplement”. I’m really not trying to make excuses for Chael. My beef is with the commission.

The punishment still fits the crime. He should have had a year suspension for the drug test (due up in September), and then at minimum 6 more months for lying to them. I just don’t see the complaint. That they screwed up in December and are now rectifying that screwup?

Two things that interest me about it:

1) She went on Mauro Ranallo’s radio show, which has a lot of reach. This isn’t just some whacko on Twitter.

2) She’s crazy. She’s talking about bringing the CSAC down. If she’s even half as serious about this as she claims to be, I expect her to pop up until Chael is allowed to fight again.

She thinks that Kizer has a personal issue with Chael? Pretty sure he just thinks that lying under oath and cheating are not acceptable and it’s his job to enforce the rules.

The strength of the punishment is debatable, the fact he was punished is not.

I definitely think Kizer is making this a personal vendetta. He wanted to stick it to Sonnen but could not do it himself since Chael’s record in Nevada is clean, so he placed a call to CSAC and had them re-examine Sonnen’s testimony. I honestly believe CSAC would have let it slide had Kizer not called in a favor.

Basically, I believe everyone involved here is either incompetent (CSAC), a pathological liar (Sonnen), or a petty/vindictive bureaucratic (Kizer). They are all scum.

I think he has a law suit

If he gets the right team of lawyers (which is a distinct possibility with his past life politician/real estate businesses), and can afford them, he could make things pretty uncomfortable for the CASC and Kizer while he is sitting on the sidelines. It just depends how far he wants to take it. Not sure the blonde he hangs with has the means to follow through but I’m guessing he knows someone who does.

Sure, he might have a case if he knows the right people, by which I mean he knows people who know a judge they could pay off to rule in his favor.

On the actual merits of what’s happened and the law? No, he has absolutely zero case.

This is what I don’t understand, it doesn’t say anywhere that you can pick any job in the universe and be able to do that no matter what you do. The government also said he can’t earn a living in his chosen field of real estate, is that somehow wrong too?

Here’s a good rule in life, if you need people to give you a license or their approval for you to do something that you want to do or to make money, don’t publicly embarrass them or otherwise piss them off. It usually isn’t going to work out well for you.
