UFC's Phil Davis Offers Thoughts on Penn State Rape Scandal and Joe Paterno's Firing
The Penn State/Jerry Sandusky child rape scandal has been front page news for well over a week now featuring twists and turns and seemingly more horrible news by the day. While ESPN attempted to say that the "healing has begun" because PSU played a football game, this isn't a story that is going anywhere any time soon.
Joe Paterno's firing was the easier part of the story for most to follow as he is a legend in the coaching ranks who was let go for his looking the other way when told that someone witnessed Sandusky sexually assaulting a young boy.
MMA Weekly spoke to the UFC's Phil Davis, a Penn State alum, to get his thoughts on the situation at his alma mater:
"At the end of the day it's just sad for the children involved and I hate to see Joe Pa (Joe Paterno) removed because of this, he's had such a long career and to have someone like him, ultimately, I suspect he's going to be remembered for the way he left, under these circumstances and that's really not fair,"

"I think he did what he could," Davis said about Paterno. "In jobs, we have protocol, and I think he followed protocol. Whether he agreed with decisions that were made, especially in a university job, you really don't have control over what goes on.
"If you're in a law enforcement position and your superior says let so and so go, you've got to follow your protocol. You can't just go ‘this is the law and I want to play this the way I want to play it.'"
First of all, someone in the UFC should probably tell its fighters to go with "no comment" on these situations.
The idea that Paterno "did what he could" because he "followed protocol" is absurd. The protocol in any job when you are told that someone is raping children is to call the police, not keep it in-house and then allow the individual in question to continue being around children at your university.
Even if you're in law enforcement and you're told to "let so and so go" if it is a case where he is being let go because of his standing in the community and there is a refusal to investigate, you don't just back off. There are actual legal protocols for that.
Regardless, this wasn't law enforcement, it was a state university and to act as though there is any "right" thing to do that doesn't involve getting the police involved is absurd.

the best strategy for someone who is a Penn State grad is to say nothing, but if you must make a comment speak to the victims first and then say it is a crummy way for a great career to end but you can see that it is the way it has to be.

If your child was raped, I doubt he would say Paterno did the right thing. Overall a very sad story but I can’t help but feel Paterno didn’t do enough. And anyone who knows how things work in Penn St. know that Paterno was like God at the school. He could have done a lot more!

You would want somebody to call the police
It is not clear that this is Paterno’s fault. We have no idea what specifically was said between McQueary and Paterno so we don’t even really know what he knew. Also he told Gary Schulz who is the head of the campus police. In many, but not all, IDK about Penn State, university police are divisions of the state police.
So I think passing this off on him is unfair not knowing what he knew and knowing he told both the athletic director and the head of the campus police. McQueary seems to take more of the blame for not doing something right then and considering he witnessed it to not follow up on it more to make sure something was done. Also Schulz seems to be a big part of the blame because he is the one who should have investigated this although we don’t for sure what he was even told.
I work in the Philadelphia suburbs at a major financial/insurance company. We have TONS of Penn State grads and the amount of excuses they have for Joe Pa and PSU is sickening.

All I’ve heard from PSU Alum and current students is fucking excuses. They act like somehow they or Joe Pa are the victims in all of this. They should have immediately fired the whole fuckin staff and anyone associated with/or had ANY knowings of this at any level.

Im a PSU student currently and I've agreed with everything that has happened so far including the firing of JoePa.... you should see how small of a minority I am though. School spirit < kids ... i dont think my school understands that really.

I don’t think it’s an exaggeration to say that Paterno was the most powerful person at Penn State/State College PA and that he wielded more power than any individual currently does at any major educational institution in the US. Until he “retired”, Sandusky was #2.

It seems to me that all the PSU alumni are pissed that this is tearing apart their university

You can’t just sit back and let something like that go. Davis needs to realize that every kid raped after the McQueary incident is on Paterno. If Joe Pa really cared he should have been screaming to anyone who would listen that Sandusky is a pedophile. Screw Penn State, and screw Joe Pa. Their inaction equals complicity in my book. Oh, it should be pointed at McQueary just as much. Guy was 28 when he caught Sandusky with that kid and didn’t stop him in the moment and then told his dad who then told him to tell Paterno. He was plenty old enough to know what to do.
But Paterno was the guy that could shut shit down.

There are reasons that everyone kept quiet in this thing (terrible reasons, but reasons nonetheless). I have a feeling that McQueary’s reason for acting the way he did (I’m talking in the years after) will make Penn State look worse than keeping him around, so they have to keep him on board to keep him quiet.

I believe he’s been an emeritus faculty member. He’s had total access to PSU facilities until a week ago.

I thought he was fired but still receives a pension of some sorts. The GA/now assistant coach is the one on paid leave because firing him would lose him as a vital part to the case even though he is not protected under the whistleblower law.

i’m really against using abuse by other criminals in prison as part of our legal system. It’s really fucked up and the kind of thing the nazis/soviets etc used to do.
Hell there are rumors going around that several scientists who complained about the BP oil spill in the gulf got framed for kiddie porn and sent to prison where they were killed.
we have the law for a reason, we should try to enforce it fairly and sanely.

You want to protect criminals in prison?
What are your suggestions? There is and always will be honor amongst thieves. There is no way you can protect everyone. You could possibly build a prison just for sex offenders. But that would be crazy. No prosecutor or judge is sentencing people to jail with the hope they get prison raped. You get desensitized when you work in the judicial system. Just as a nurse or a doctor working in the ER.

You don’t think cops and DA’s trot out the possibility of gang sodomy in gen pop when they want some cooperation or a plea? They absolutely do.
Honor among thieves? What does that even mean? If you think some “code” is more relevant than your skin color and group you affiliate with in prison you’re wrong. Nobody trunks drugs in their rectum or rapes another prisoner because of honor. You do it to keep yourself from being a target.

There is absolutely honor among thieves.
Not just in jail but on the street. It can be just as simple as not snitching or taking the rap for someone else. It is there. Don’t kid yourself. Speaking as someone in law enforcement I see it on a daily basis.
We don’t threaten criminals with jail rape if they confess to a crime or cooperate. That is absurd. As for dealing with criminals go, you arrest them and take them to jail. If they get a light sentence or get off, it is what it is. You move on.

Thieves and gangsters have what they call as honor, soldiers have what they call as honor, law enforcement has their definition.
It is all perspective and where your loyalties lie.

It's not a virtue if it's completely contextual.
That’s loyalty and there are plenty of examples of it being “dishonorable”. Like this case, for instance.
Honor is doing the right thing, regardless of context. Standing up to your friends when they’re wrong, even if it means protecting someone you dislike.
We can disagree on what the “right thing” is, but if you’re attempting to paint different actions in different situation with the same brush as “honorable”, I disagree with every part of that.
It’s why I have no problem voicing support for the execution of those Soldiers that raped that girl, killed her entire family and then burned their bodies. Every one of them should die.
I also support the idea of a police force and LE in general. I have no problem seeing cops go to jail for illegal activities.
Context/perspective doesn’t matter.

If this Penn State thing has proved anything its that the University has failed in educating.
Who in their right minds thinks that going to people within the school to report a rape of a child is doing enough. You have to be pretty damn stupid to believe anything would get done when it could tarnish the football program. As it is obviously more important than giving a quality education.
If these students at Penn State had half a brain they would be condemning the whole coaching staff and athletic department by making a statement that these people need to go.

We all have opinions. You are on this site partly out of the desire to express yours. I do feel he is wrong, for the most part. We don’t know what Joe Pa did when he heard the news. It looks like he did next to nothing, which imo, if true, he should be brought up on charges. Hell, the way these stories work, I wouldn’t be surprised if we found out Joe Pa was raping kids too, by the end of this.

to be honest, i do sympathize a bit with people doing the wrong thing because they get pressure at work or because they are afraid of getting into trouble.
but i just don’t get how there can be any debate that all the individuals involved made a horrendously bad decision. in particular, i have no idea why anyone could have any sympathy for this coach.
when a child is being abused, there is a duty to report it to the police. it does not matter what your job is. NOTHING else matters. sure, we can make up some hypothetical situation (like an undercover cop hearing about it on a wiretap, or a lawyer learning from a client, or whatever). but this is fucking FOOTBALL. it literally matters LESS than the academics at these insitutions for everythign except money.
what is controversial about this? how in god’s name could the coach expect to keep his job?

Removing JoPa’s name off the Big Ten trophy is kind of shity in my opinion, not that the article is about that. I just wish people could separate his football legacy and his major fuck-up regarding this situation. I have a feeling I’m one of the few who feel that way though. I think when something like this happens, they just do everything they can for damage control, even if it’s trying to remove the history of the greatest college football coach of all time. Firing and an investigation seems like plenty to me… What’s next, are they going to take away his NCAA record for winning the most games as a coach?

He didn’t call the police. Given that Sandusky was still involved with this charity he didn’t inform the right people there. He failed in his responsibility (as a human being) to protect children and he failed as The Man at Penn State by not protecting the integrity of his program. He failed, period.

Sports should be secondary to education in colleges, but for most it is not. I just say split the damn things up.
In the interest of disclosure, I suffered a nervous breakdown and spent 2 years of my life depressed because of some stuff that happened in college. If my friend had been able to get in and be my roommate as we had planned, I think he would have helped me prevent that. Instead, because of the college football team having a banner year, applications tripled and he did not make it in.

I think old, storied football coaches are just like the royalty of European countries. Sure, they present a position of power and respect, but they are really just figureheads. Something tells me Jimbo Fisher was the lead for Bobby Bowden for quite a few years, and I think the PSU staff carried Joe Pa as well.

actually i'm very aware of it and have read it several times
obviously none of you guys are…first off…i could care less about Penn State and/or Paterno, but I feel that too often people in the media state things that are not facts.
Regarding this case with Paterno, the main argument is with Victim 2….the report is actually contradicting on what was actually said. We don’t know for sure what McQueary told Paterno or others as they are disagreeing what was said. He states he said anal sex, but they said that he said wrestling or fondling – which obviously is a HUGE difference. So, unless you were there – you don’t know what was said or what convo he had with Sandusky afterwards. Who knows, maybe he said wrestling because he was afraid of getting fired and then Joe talked to Sandusky and he lied his butt off well. All the other cases there is no real link to Paterno that he could be aware of any misdoing.
Do I think he probably knew what was going on and could’ve/should’ve done much more? Yes, probably.
Do I think Justin Bieber got that chick prego? No, probably not.
Both of which I don’t know to be spouting off like Brent is doing in this article.
Well, I have a masters degree from Penn State and I give money to the alumni association, so unlike you, I do care about Penn State. the articles commentary… Phil Davis knows (like any Pa resident) that Joe Pa… IS PENN STATE… No one at that University has as much clout as Joe Pa…. He could have and SHOULD have done much more… And he will be remembered for it.
I’m a HUGE PSU fan… having grown up in PA and watching Joe Pa coach for 30+ years. I’ve revered the man and his accomplishments on and off the field… But in light of these accusations and his handling of them… I’ve come to realize Joe Pa is just a coach…. a man with faults… Faults that harbored and abetted a pedophile…..

Having parents who have fostered children now for thirty years I have seen the kids that come out of things like this. It isn’t a great picture and these things end up haunting them for the rest of their lives. Even if they get over the pain, it still ends up effecting them and their choices from the moment it happens out.
Sexual abuse destroys the most precious thing in the world, a child’s soul. Those who know it is happening and do nothing deserve at the very least to spend their eternity in suffering. Those who make piss poor excuses for their not having the humanity to do what is right deserve it just a tad less.
It’s amazing that Davis wants to try and make a argument like this. Especially considering that if a officer, a teacher (like my wife who has multiple times called CPS over suspected abuse), so many other fields knew something like this were happening and did nothing they would at bare minimum lose their jobs. More than likely they would even face criminal charges. Just the suspicion of child abuse either sexually or physically requires these professions to to step up and report those suspicions to the proper authorities. Human decency requires that the rest of us do it.

It was on The Daily Show/ The Colbert Report last night
can’t remember which one… seriously though, just the way he SAYS it is so creepy. I try to be objective, not judge a book by it’s cover, and all that, but I’m POSITIVE just from the way he talked about it that he is a sick fuck.
It’s like how Roethlisberger talked about his sexual assault charges… the way he talks just exudes guilt

The NBC interview he gave was pretty damaging to himself. His lawyer is an idiot for letting him speak.
Everything he said was absolutely creepy, especially his response to the direct question about whether he was attracted to young boys. I know everyone is innocent until proven guilty, but holy shit, did he sound fucking guilty.

GJ make Dana be the slave master even more over these guys. No one in the UFC can talk about anything due to being so afraid of how much power this man has. While I certainly don’t agree with Davis, I don’t believe muzzling him is right.

No good could have possibly come from Davis bringing across his point of view here.
If I see a man showering with kids regardless if there’s sexual contact or not the only way I’m not calling the cops is if I go get a bat and pumble the degenerate and that’s no tough guy talk, that’s I’m a dad and that’s what I’d want another dad to do talk.
In most situations it’s easy to be hypicritical and have 20/20 hindsight when your not in a situation and say oh I would have done this or done that… BUT in this case if you witness this or even hear about this how do you not contact authorities how is there any other logical action… ? Even if you don’t want to be “that guy” you can just call anomyously and give enough info to get the ball rolling… this is just pathetic.

Strange that so many people think the UFC should put a gag on these fighters especially Brent Brookhouse. Do you really want PR reps fielding any and all questions or do you want real opinions ?? There won’t be much traffic on BE to read “No Comment”

What happened to the boy isn’t fair. That doesn’t somehow change Paterno’s status. We have no idea what exactly he was told by McQueary. He did not witness the act. And he passed it onto to the head of the campus police and the a.d.

I am done with Penn State Pride. Over it. Listen, I have more Penn State Pride than any of you. Except maybe my brother. Still, I was wearing blue and white in the womb. I had my future college planned before I could read. I made my first visit to office hours at age 4 when daycare wasn’t running over the summer and my dad took me to work. I’ve lived in this town for all of the life that I remember. And all this week, I’ve heard again and again about Penn State Pride. And I heard it again at the candle light vigil for the victims, Penn State Pride.
This is not about FUCKING Penn State Pride. This is about a predator and the survivors of his crimes. This is about how to help THEM and how to stop HIM and anyone like him from raping children again.
Yes, I will be at the game tomorrow, and yes, I still love my university. But can we please, for ONE SECOND, realize that this is much bigger and much more important than our institutional pride or identity? That this is not about reputation, or image, or even football? This about justice. Not rallying the troops or circling the wagons. Doing those things is how we got here. Never forget that what happened was not a result of insufficient pride, it was a result of people placing that pride above the morals that said pride is supposed to stem from.
No more about Penn State Pride. Let’s talk about justice, and let’s talk about healing.
