I would like you to ask Bjorn Rebney a couple of questions:
- Will Roger Huerta be fighting outside of Bellator soon?
- How did his recent conversation go with Scott Coker go? What are the odds we’ll see Eddie Alvarez vs Gilbert Melendez (if they both defend their belts) ?
- Any truth to the rumored Strikeforce vs Bellator New Years event? If not, I would like it quelled now so I don’t end up getting worked up for nothing.
- What are the odds of getting a consistent TV schedule for next season?

My issues with Bellator and a couple questions for Mr. Rebney.
I bring this up more than I probably should but it seems like a big deal to me. I mean considering how everybody always talks about how bad Zuffa’s likeness rights stuff is I think Bellator should be held to some kind of similar standard on such issues. Don’t get me wrong I’m not happy about the extent to which Zuffa goes with some of it’s likeness rights issues either but I just think there should be some consistent form of criticism. If what Zuffa is doing is bad then Bellator should endure the same criticism for their trademark clause.
Here is what I’m referring to in case no one is aware. On MMA Payout last year they did a breakdown of Bellator’s contract. That can be found here: http://mmapayout.com/2009/03/inside-the-bellator-contract/
In that breakdown the writer describes Bellator’s trademark clause as such:
One area of the ancillary agreement that is raising the ire of fighter advocates and mangers is a clause that has Bellator reserving the right to register as a trademark the fighter’s name, stage name, or identity for the purposes of Bellator carrying out their promotional duties. This sort of arrangement hearkens almost to the type of deals prevalent in the WWE, where the company holds trademarks over the performers stagenames and likenesses. As jaded as MMA reps are at this point by the contractual grabbiness of Zuffa contracts, this clause is seen in some quarters as being beyond the pale, which takes some doing. While some of the higher profile fighters like and Eddie Alvarez likely have the pull to bargain this clause out of their final deal, it leaves the majority of Bellator’s fighters with a bad deal in respect to the trademark issue. If they hold to this clause steadfastly, they may run into problems in the future recruiting new talent into the organization, provided they continue as a going venture.
Requiring the right to trademark a fighter’s name seems awfully bad to me. In fact this line sums it up:

Bellator’s trademark clause is “beyond the pale” compared to Zuffa’s but Zuffa gets killed and Bellator gets no criticism. Something about that is just very confusing to me. Does Zuffa deserve it? YES!!! Why then doesn’t Bellator deserve to get the same criticism??? I’m beginning to think I’m imagining something with this issue because nobody else seems to care that Bellator has this trademark clause. Granted they haven’t used it yet but the fact it’s in there and can be used is enough to warrant the criticism.
I hate to make this a long winded rant but while I’m at it. Another thing that seems excessive is this clause they have:
The contract also has a clause that states that if a fighter is declared champion of his division, wins a tournament or is a tournament runner-up, the contract automatically extends by 18 months or three fights.
I can see the need for promotions to have a champions clause. However I think they should be making an attempt to negotiate fair extensions rather than just automatically extending them at the current pay rate. So the fact they are automatically extending not just their champions but also their regular tournament winners and runner-ups seems a bit excessive to me. My question for this would be in the case of these automatic extensions they can only automatically extend the contract of their champions and these tournament runner-ups and winners by 3 fights one time and one time only right? Then they can become a free agent and test the market right?
Now to be fair that breakdown of the Bellator contract was done last year and they may have changed them after some complaints. However if they did no one has reported on it so I’m assuming those clauses are still in there.
While I’m at it one more question for Mr. Rebney. What are the issues between Bellator and Dave “Pee-Wee” Herman? What is the status of his contract and where does that stand in the courts?

Are you still claiming Chuck Liddell eye poked his way to stardom? Saw your article on Chuck after UFC 115…wonder if you’re changing your stance on such a silly argument. Your book was great on the backstory of MMA and its origins but parts like your rant on Chuck bring into question the objectivity of the rest of your book.
Is their some question about whether Chuck poked a bunch of dude’s in the eye? I don’t intend to defend one paragraph out of hundreds of thousands of words in the middle of someone else’s post. Make a fan post, blast me if you want, and we’ll talk there.

I think if contextualized properly it can attract listeners. Any good subject can attract intelligent listeners. I mean what do fans in Manassas want to listen to anyways if they tune into an MMA radio show? As far as casual/superficial fans are concerned an MMA discussion about anything extending beyond a Brock Lesnar vs. Mike Tyson argument are unlikely.

The show was almost canceled for talking about DREAM, which arguably has a tantamount television presence and more MMA relevancy. People do not understand what drives ratings in talk radio and it sure as hell isn’t Bellator contract minutiae. The questions themselves are fine, but talk radio is about big topic, as mainstream as possible discussion points.

Kimbo Slice, Brock Lesnar, UFC and Dana White. They’ll tolerate other topics, but their patience is thin. I’ve been doing this show for two years in all sorts of time slots. I’ve looked at the ratings over and over again. Why did the numbers jump here? Why’d they drop there? The answer is they want to talk about the UFC. I’ll include other stuff so I can create digital content for BE or because I’m personally interested. I’ll pay the ratings tax, so to speak, just to do a show I prefer to do. WEC, Japanese MMA and most everything non-UFC is more often than not ratings poison. Strikeforce doesn’t do much either unless Herschel Walker is fighting.
When September rolls around, the station will talk nothing but the Redskins from 5am to 11pm. Everyday in every show. Is that because questions about trademark usage in Ovechkin’s contract don’t matter? No, it’s because it’s not what the listeners care about. This isn’t PBS. We are a ratings-based platform. I talk UFC as much as possible because I want to keep my job.

I hope this means your show’s not going away. If your show was to get cancelled in favor of more Redskins talk I will go from someone who doesn’t care about the Redskins to a full blown hater. I think the over saturation of Redskins talk on 1067 was brilliantly satirized in the first episode of Main Street Mafia by Mr. 1067 himself.

But I thought it was illegal to ‘trademark’ someone else’s birth name? What WWE did was trademark the characters they created for their wrestlers. For example they couldn’t trademark ‘Kurt Angle’ so when he went to NWA TNA he could still be ‘Kurt Angle’. But they could trademark ‘Mankind’ which was one of Mick Foley’s wrestling characters so in NWA TNA he has to be Mick Foley. Or take Lisa Marie Varon who was ‘Victoria’ in WWE has to be ‘Tara’ in NWA TNA.
I think Zuffa’s image likeness clause simply states that they will be allowed to make money of a fighter’s image and likeness in perpetuity even after that fighter leaves the promotion without owing the fighter any money. Case in point, Kimbo Slice. They continue to advertise him in commercials and so forth for UFC Undisputed 2010 even after cutting him. I don’t think Zuffa claims to ‘own’ Kimbo Slice’s image and likeness. I don’t think they can legally ‘own’ a fighter’s image and likeness and not allow it to be used in any other medium. That’s why Dana came out with his ‘if you do any other video game besides Undisputed you will be banned from the UFC’ because he couldn’t legally enforce any sort of trademark clause on a fighter’s image and likeness.
So what Bellator is proposing seems completely unsustainable legally. If Ben Askren leaves Bellator and decides to fight in the UFC, he won’t owe Bellator anything and won’t have to change his name or get plastic surgery. This clause really has no teeth because MMA fighters don’t really use personas or scripted characters and so Bellator has now claim to intellectual property. All they can do is insist on being able to show Ben Askren’s fights on replays or whatever after he leaves and not owe him any residuals or anything.
I remember the discussion we had about the contracts at the beginning of the year. Good to see you trying to shine some light on them.
Just trying to keep it out there because eventually I think it’s going to cause some problems for some fighters. Just like the likeness rights issues has been a bit of a problem with some Zuffa fighters.
Hell I would just be happy for now with someone asking Rebney if those clauses are really in their contracts because other than that one article on MMA Payout I don’t think anyone else has bothered to report on it. Not that I don’t trust the article on MMA Payout but it would be nice for a second source to confirm it.

well he wont FOTN. And that point deduction was BS. I say give him one more shot it would look real bad for the UFC to cut a FOTN fighter after all of Dana’s talk about ‘fighting your best’ and how winning isn’t more important than putting on a good fight. They kept giving Guida second chances until he started to turn things around.
what the hell Jonathon Snowden wants to ban me for critiquing Total MMA? What’s going on here? I’m not insulting him or anything but if he wants me to start a full thread about his post-UFC 115 article seems a 180 degree about face from how he slammed Chuck Liddell in Total MMA I will.

I made my own fan post. And take it as bashing but it’s real critique. There’s a difference. And I had a simple question, did you change your mind on Liddell? You can respond to the fanpost.
LOL @ hijacking a post advertising a radio show only people in the DC metro area and N. VA can hear. The ustream feed doesn’t air any of the callers. So the talks with Kris McCray and Bjorn Rebney will only be heard if you can hear the live terrestrial feed or if the board ops don’t screw up recording the pod cast which seems to happen 50% of the time. Otherwise you just watch Luke talk to himself and bitch about how little 106.7 cares about his show during the commercial breaks. Wonder if it was a coincidence that when Chad Dukes hosted the show everything ran smoothly it seemed like.
