Chael Sonnen Suspension Reduced to Six Months, Josh Barnett Gets Continuance
After a remarkable hearing the California State Athletic Commission voted 3-1 to reduce Chael Sonnen's suspension to six months from one year. Sonnen failed a post-fight drug test after UFC 117 when his sample showed elevated levels of testosterone. His $2500 fine was not changed. The panel first voted 2-2 to uphold the original suspension.
The commission members offered no rationale for their decision.
The CSAC granted Josh Barnett a continuance when he showed up without legal counsel for his licence reinstatement hearing. He was denied a license after failing a steroid test in 2009. Barnett's failure to get his license renewed will complicate Strikeforce's efforts to book him to fight in the U.S.
After the hearing Barnett tweeted:
Wow. I show up only to re apply and get ambushed by an assistant AG who has put together a case against me. Sweet.
And Barnett also tweeted this, presumably in reference to the Sonnen ruling:
Wow x2! Just heard that the CSAC allows people on steroids to fight w/ the right scripts, approval, and tests within a range.

This hearing was good for the UFC's business and bad for Strikeforce's
For the record, I thoroughly disagree with reducing the sentence to 6 months. I was incredibly surprised that no one even really mentioned the extent that his testosterone was higher than normal.
He took the shot the day before so

The testimony on the CSAC doctor is that if you inject one day then your testosterone levels drop below normal after what you injected get worked out of your system. So you can get an even lower testosterone level than you would normally by shooting up a day or two before hand.

I am not aware of his actual testosterone levels being mentioned
Does anyone have any info on this? The only thing I have seen is regarding the T:E ratio which is meaningless in this context.

It seems like they meet every 3 months.
As for other states, peopel in the live blog mentioned Texas, but I’m not sure. With Margarito, Nevada passed because it was unresolved in CA. Texas gave approval after California officially denied him. Josh is still in limbo right now, and that’s what lead Nevada to not look at his application.
Will Texas (or anyone else) license Barnett while he’s still in limbo?
What I don't understand is...
It was reported that his testosterone levels were 4x higher than normal, but the commission stated that they didn’t know if his testosterone levels were higher than normal. How the hell do they not have this information? They weren’t sure whether Sonnen popped because of artificial testosterone or because of high levels of testosterone. Complete incompetence.
It’s really simple guys…if his testosterone levels were extremely high, he’s a cheater. Whether he has a deficiency or not, there’s no reason for it to be that high. If his testosterone levels were artificially enhanced, but within normal levels, give the guy a break, because he’s not gaining a competitive advantage in that scenario.

The high T/E ratio test is a red flag only which then leads to the (expensive) liquid chromatography tandem mass spectrometry (LCMSMS) test to determine if the testosterone is natural or synthetic.

I never saw that his total test level was given. His ratio of test to epitest was given, bit that doesn’t tell us if his testoserone was above the limit.

But in theory if his epitest was extremely low, his test levels could still be “normal” and get that ridiculous T/E. I doubt it’d be 16:1, but you’d think they’d give his actual testosterone level for the slam dunk.

As best I can tell, they don’t have it. It can really only be accurately derived from a blood test or a 24 hour urine test.
If he truly is hypogonadal, having taken an injection the day before the test could certainly result in an extremely high T/E ratio.

It's very normal to reduce a suspension or fine just for simply showing up and contesting the matter.
I’ve seen it in Courts in Washington State and Hawaii. This isn’t some outrageous ethical tragedy. It’s par for the course. There’s no foul play involved; no payoff. I have seen admissions of guilt result in a reduction many many times.

Someone correct me if I’m wrong, but I believe Sean Sherk, Hermes Franca, and James Toney all had their sentences cut in half after they respectively argued the results were invalid, admitted guilt, and cursed at the athletic commission.

Everything probably went very well in the preparation on Chael’s end but everything changes when you’re in front of a Board. When there is a set amount of time (30 minutes for opening arguments; followed by 15 minute rebuttals) I would consider it a tactical advantage to make everything as jumbled as possible. As the defense attorney you know they aren’t going to completely throw it out (given the history of the CSAC) but you can at least try to cause some confusion and look for a last minute reduction.

if you get a speeding ticket and show up to fight it it generally gets reduced. if you fight a multitude of charges the DA will take a plea bargain down to a lesser crime/punishment.

I have no real feelings either way about the suspension being reduced, but I listened to the hearing and I’m really surprised. It seemed like only one member of the commission showed any sort of sympathy for Chael’s “story”. The other 3 asked questions and came off like they thought he was full of shit (which he was, according to Keith Kizer). I expected them to uphold it for sure when all was said and done.
I know little about these procedural matters, but it was pretty dumb overall. Calling clock on Chael’s defense team continually while giving the “prosecution” as much time as they wanted. The woman rebuking Chael for speaking “disrespectfully” when he did nothing of the sort, etc. It seemed pretty one-sided. And Chael’s mumbling doctor certainly didn’t help.
Overall, I’m just really surprised.

Sonnen seems like a pathological liar that would say anything he thought benefits him. That’s why he’d cop to never going through puberty, or having hypogonadism. He doesn’t care what people think about him as long as the $$ keeps coming in. How his word has any credibility after all that shit he said (and denied he said) in the run up to the Silva fight is beyond me.

He had a doctor who said he tested low and that he needed it. I have no reason not to believe it. Especially since apparently his level’s weren’t elevated. I mean if basically you can get some shady doctor to give you a script for testosterone it seems like these guys are gaming the system. I personally am a fan of Dan Henderson and i hate to bring attention but will he then pass his test is this basically just these guys cycling of by the time they take the test?

Bending the system I think
It’s natural for guys as they age to have lower testosterone. I am pretty sure this is how Couture and Hendo have stayed competitive to their late 30s and beyond. But also I have read that cutting weight can damage the bodies ability to produce testosterone, so with all three of these guys(Hendo, Chael, Couture) being accomplished amateur wrestlers, maybe they have a legitimate claim as well.

and I have heard mention of Hendo as well, which makes sense.
But. There is no known connection between cutting weight and testosterone production. I have heard this several times, but it is not correct.

Do actual mainstream sports allow this?
I mean, I feel like most NFL players juice or have juiced…but are there any players who take shots of T openly?

I’m not sure what their rules or testing procedures are, but they would have therauputic use exemptions available as well.
I suspect hGH is used more than anything else in the NFL
I’m of the opinion that a significant majority of pro athletes in contact sports use or have used PEDs in general.

Most NFL players juice up in college, then stay away from it in the pros. I don’t know about other sports.

baseball banned amphetamines, and now 10% of the league has exemptions for ADD meds (3% of non-baseball players take ADD meds).
So there is a precedent in other sports for therapeutic use exemptions, not sure if any other sports particularly allow testosterone though.
I know; that is hilarious how they game the system
But adderall is nothing compared to the old greenies. I am friends with the A’s equipment manager. He said he tried a “greeny” back when they were around, and he was ready to go flip cars and run sprints.

Obviously, I don’t know what the UFC is planning. But a 6 month suspension is perfect for them time-wise.Vitor-Silva in February. Assuming Silva wins and doesn’t suffer some crazy cut, that’s about 4 1/2 months-ish till Chael’s suspension is up. Also assuming Chael is allowed to train while suspended. They could put on a rematch without delaying anything.
