The War Has Just Escalated...

Zuffa has just sent Strikeforce a cease and desist regarding the Babalu versus Mousasi fight... expect the same for Fedor's engagement.

The war already started between Zuffa and Showtime years ago and this is simply a different chapter in the same saga.  Showtime's new proxy: Strikeforce... EA and potentially CBS coming into the mix - there are multiple fronts in play.

Zuffa's pay scale has already been gearing up to preempt this and many don't realize the Affliction "collaboration" has more implications than meets the eye.

With Zuffa's warchest increasing by the minute and more revenue streams being added by the day expect the payscale to continue its increase.

My bloody elbow brothers probably expected an apology from me as "I guaranteed Fedor's next fight would be in the UFC"... and rightfully so after hearing the strikeforce/fedor announcement.

But pay heed my brothers as you've only seen half (Zuffa's amazing offer) of why I guaranteed it... The other half - the stick - is yet to be pulled out.

Always bet on Zuffa.

They’re trying to tie everyone up in court by suggesting it’s illegal for them to fight for anyone else besides Affliction, I believe.

I’m not certain, but I believe these fighters are still under contract for one more fight with Affliction and because Affliction isn’t promoting another show they can’t fight elsewhere. I’m not 100%, but it’s something along these lines.

The bottom line is these fighters need to settle there Affliction contracts before they can do anything.

The contracts don’t become void when Affliction folded as a promotion? Or does Zuffa have some kind of deal with Affliction concerning the contracts?

 Forgive my ignorance, I don’t know anything about contract law.

They chose not to re-sign Babalu after that incident. Of course they dropped him after the first loss to Liddell too. The UFC drops fighters all the time and brings them back later. It’s not beyond reasoning that they would take Babalu back now (although Babalu seems to be doing fine for himself as a bigger fish in a smaller pond).

The cease and desist on the Babalu vs Mousasi fight may have a different reason for happening than the UFC mad about Fedor signing too(although it gets to the same issue).

I’m not giving credit right now. I also am not lending truth to this rumor either. SF didn’t announce anything yesterday, so what’s the story? Coker seemed completely unphased by anything in his radio interview.

And this rumor has nothing to do with Dana White, so I’m not sure how reliable this will be. It could very well be reliable, and I would love to see it be reliable.

We will know soon enough(she’s a UFC shill but I didn’t think she would boldfaced lie about something like that), if that was true then you know Mousasi won’t keep his mouth shut about it. Thing is if that is true it changes the complexion of this story too. Them serving the C & D on Strikeforce may of had nothing to do with the Fedor signing or them declaring ecomomic war on Strikeforce it may be because of a bad faith negotiation.

I’m not sure this is a smart move on the UFC’s part. They’ve clearly got public opinion on their side right now (even among hardcores). I don’t think fans will react to positively if they perceive the UFC as standing in the way of them seeing fights they’re looking forward to.

Yeap, same exact thing. He has even eluded to (but can’t actually directly say) he is stuck in Strikeforce until the contract runs out.

Strikeforce was playing hardball with these guys. And that was okay with everybody. Now Zuffa does it and people complain.

I wonder how much Showtime and CBS are willing to put into a fight with Zuffa. Winning this battle has to be worth more to Zuffa. I expect they will put far more time and resources into it.

Showtime & CBS won’t want to spend millions on lawyers. Their goal is to make money quickly, not lose $45 Million before turning a profit like Zuffa.

Always bet on the guy who has more invested (both emotionally and financially). And that is Zuffa.

This means nothing to Showtime because it’s just a tiny part of their business.

perception is more important then reality. Is he money in the bank? no, but he is a 1-D fighter that is overvalued because of his performance in the spotlight. If he were touted as the number one HW in the world and fought in the main event while Carano was on the undercard, then he might be a HUGE draw.

I’m agreeing with most of this, in that people who tune into Showtime to see Fedor, are mainly the ones who already know who he is.

It will be easy to build up Fedor, but they need big names for him to beat up on. Beating Rogers or even my boy Overeem, will NOT gain him a lot of fans. So I guess we can expect to see Fedor vs Ken Shamrock pretty soon.

But in terms of bringing in new viewers, which I think is what you are referring to, I don’t know how much it actually helps them, especially in the United States.

Fedor already signed with Strikeforce.

If the papers are done and signed, they probably can’t and won’t change their opinion. They choose Strikeforce. Signing a contract is more than wanting to put pressure on the UFC. They really want to fight in Strikeforce.

What it looks like is going on here is that Fedor had one or more fights left on his Affliction contract and now the UFC holds those assets. This gets us into a situation where things can get tied up in court for months or even years going back and forth. Heck there was talk coming from M-1 and Affliction that they were about to sign a long term contract together, that could really make this a mess if that deal was done.

It’s also not a UFCcentric thing either, Strikeforce took EliteXC to court when EliteXC signed Frank Shamrock and he still had Strikeforce fights on his contract. It really sucks ass but this stuff happens. Honestly the whole situation is going to make me sick but lets not act like this stuff doesn’t happen in the business world every single day.

Fedor never was signed with UFC or even with Affliction.

He is under a M1 contract and M1 has an agreement with Strikeforce. As simple as that.

I hope the UFC does not play the butthurt card. White should stop acting like a child.

Fedor was signed with Affliction, at one time he was North American exclusive and I think before the January card he became worldwide exclusive. There was also talk coming out of M-1 and Affliction a month or so ago that they were real close to a long term contract on Fedor. There is a real chance here that the legal mess will go very deep.

You really need to cut out the acting like a child bit here. Yes calling names is acting like a child but this kind of legal fighting is as grown up corporate business as you can get. This stuff happens every single day between companies over contract issues. This is a whole different ballgame than Dana being Dana, heck this is probably coming from a whole different place in Zuffa than Dana running his mouth, this is legal issues.

I have read numerous Tom Attencio (and others) interviews where they said he was. If he wasn’t under contract with Affliction then this couldn’t happen and if he is then M-1 made a huge mistake signing with Strikeforce before they cleared up the status of his Affliction contract. I’m not going to argue with you about it because it is what it is, they can’t make up he was under contract with Affliction to file a cease and desist they actually have to have the contract in hand, if they do then this is exactly what will happen and nothing anyone said in any interview will mean squat to it. We will know what is real and what was just interview fluff soon enough.

Typical lawyers. Every company I have ever worked for, the lawyers don’t do anything like the rest of the company. They kind of lurk in the background, and when they are 100% certain that something will win in court, they go straight for it. Lawyers for major companies typically don’t bring on frivilous lawsuits. At least from my experience.

If the lawyers gave the OK, it is likely legit.

Here's what happens

Coker put all his cards on the table. Dana was giving him a pass up until he went for the gold. CBS + Strikeforce does not equal ABC/ESPN + HBO. Yeah, I said HBO. Like they’re not watching this mess.

And yeah, the UFC will take fighters from Strikeforce because they can. Big poo poo for Strikeforce but if you’re Coker you gotta try that.

IMO there does need to be one premiere league for MMA and the UFC is obviously it. It just looks like it might take a little longer. But, this might help MMA in the long run – regarding fighter contracts and sponsership deals – and driving one more competing org. into the ground. Strikeforce should have tried to stay in the minor leagues.

How does this affect Mousasi then? I assume he had a N American exclusive deal with Affliction, since he is still fighting for Dream in the Super Hulk Tournament. Therefore Zuffa has this deal? But since Zuffa only do exclusive contracts, he will not fight in N America and Zuffa can sell his contract? So Strikeforce either take Zuffa to court or pay them a shitload of money for the Babalu fight which takes place in 11 days

Just because the UFC doesn’t do those types of deal doesn’t mean their legal staff won’t act on the Affliction contracts if Zuffa now holds those assets. Heck Zuffa would almost have to do something if they hold those contracts, it would be their fiduciary duty to take care of that issue. Obviously they could end those contracts but they couldn’t just ignore them if they hold them now. What we could end up with is a situation like after Pride where a lot of guys just sat out their old Pride contracts and that sucks ass but legally that would fall at Affliction for not freeing them up before they kissed the Zuffa ring. It’s a situation where everyone is a bad guy here except for the poor fighters trying to make a living but caught inbetween because of M-1 and Zuffa butting heads.

Zuffa has to protect their legal rights. The legal system almost puts companies in a bind this way. If they don’t protect, they lose the rights.

I have a feeling Zuffa was going to let it slide with Mousasi and the rest of the Affliction people. And then Coker announced Fedor before his Aug 15th show. big mistake.

But it will not happen. Vadim is too smart. he owned White after Pride demise and will continue. If he has refused to sign a contract with Monte Cox because it was not in Russian there is a reason.

I never said that walks were a draw.

I said for hitters like Bonds or Ruth I consider them to be a draw from the pitcher’s standpoint, which is a relatively weak position, since even the greatest hitters rarely exceed a .600 slg% for any significant portion of their careers, which is 3/5 of a base on average for each plate appearance.

But it’s how I look at the big boppers. Only the top-shelf elite, though.

It is more that you suddenly seemed to jump all over this. I take his word as someone who has inside information, but I use that along with other things I hear/read to draw my own conclusions. Given the “person’s” attitude, if it wasn’t so arrogant… I’d probably just ignore it but it struck a nerve and I pounced on it…but much like the whole Fedor situation, I’m over it and ready to move on.

Kizer and Buffer are usually good. My favorites are when some random guy goes ranting off on a fighter then said fighter posts back owning them.

I loved Felix and Mats, I’m a die-hard Leafs fan.

The new brutally violent truculent Leafs are going to have a field day curb stomping the Sens.

Also: if Silva beats Griffin we all get to see subo throw a tantrum over having to rock a Kansas City Chiefs logo until the next numbered UFC event.

Zuffa cant stop M1 and Fedor from doing what they want. If anything Affliction is in breach form cancelling the show. Affliction never had exclusive contracts with Gegard anyway so how can they stop him from fighting for strikeforce. Zuffa cant illustrate that they were damaged by any of this unless they start planning for a Babalu Gegard fight in the UFC right away. I guess they can get a judge to listen to them and maybe force Babalu and Gegard to delay the fight but i still think it’s a long shot.

This is what I'm thinking...

Affliction said it was not going to promote events anymore and became a primary sponsor for the UFC. All fine and dandy, right? Well, Affliction never actually closed it’s doors, just said, “Hey, we’re not going to promote fights anymore!”

What if the UFC funds Affliction to promote their final show, and the UFC co-promotes with Affliction for that final show?Aren’t all of the fighters signed to Affliction contracts still bound by that last fight? What’s stopping Zuffa to give Affliction money to host its last show, or at least be UFC 103: Affliction, and use the fighters from both organizations?

I’m not sure of all the legalities of this, but essentially, I would think that there is nothing to stop them unless it specifically states in the contracts otherwise.

Is this a possibility?

Yeah this is something i thought of too. Now that Affliction clothing is back with the UFC and they have (speculation) first rights to all the Affliction fighters.. who knows. But every day a report comes out that changes this whole UFC/Affliction/Fedor situation.

This has been a whirlwind of changes the past few days, but I can’t see why this wouldn’t work, as long as the contractual obligations of the fighters bound to Affliction are met.

Just something to think about, but it’s an interesting theory I think.

TJ DeSantis on Sherdog radio just mentioned UFC has sent Strikeforce a C+D letter in regards to the Babalu/Mousasi fight. Strikeforce’s Mike Afromowitz responded by saying Babalu is Strikeforce’s property and has been since 2007 but didn’t say anything about Mousasi.

But if he also signed with Affliction, it’s going to be a complicated mess.

The way these contracts are signed is going to be especially confusing, but I wonder if the presence of bout agreements from Trilogy could factor in at all.

So wait; these fighters sign contracts with Affliction, a promotion that paid people completely unrealistic amounts of money, antagonized the leading competitor (which is know for being willing to spend money to quash competitors), and which has been trying to get out of the promotion business pretty much since they started, and they didn’t a) guarantee certain amounts of money regardless of whether the show went on or not and b) didn’t give themselves an escape clause if the org went tits up?

These guys really, really, need a better lawyer. Seriously. This is just terrible.

If this is true

then it’s a serious dick move on Affliction’s part.

They cancel an entire event, less than a week out. And then they tie up the fighters they just screwed in court.
