Nick Diaz Pre-Fight Drug Test Problems Might Cancel His Fight With Jay Hieron at Strikeforce: Carano vs Cyborg
MMA Mania has the news:
Controversial Strikeforce welterweight Nick Diaz could watch his August 15 title fight against Jay Hieron go up in smoke after missing his scheduled pre-fight drug test on August 7.
The California State Athletic Commission (CSAC) made arrangements with Strikeforce to reschedule Diaz for today (August 10), however, Diaz has yet to arrive at the testing facility.
The CSAC cannot accept a sample any later than this afternoon if it’s to be processed and reported in time for Saturday’s "Carano vs. Cyborg" event. Therefore, unless Diaz submits a sample today, his scheduled bout against Hieron will be scrapped.
From Scott Coker at the Strikeforce press conference:
Caesar Gracie told me Diaz [missed his Aug. 7 drug test because] he was in the mountains training. He's supposed to be on his way (right now) to Los Angeles to take his drug test with the California State Athletic Commission. He has until 3pm to get it done. We're hoping he makes the right decision. [If he does] we should have the results by Thursday. We have a contingency plan in place if necessary. Regardless, Jay Hieron will be fighting on August 15.
Dave Meltzer comments:
"Well, hey listen, listen, I don't have any sympathy for the guy because he went, you know, he went in the LA Times and he bragged that he could beat a test at any time and that he was still doing it and he's the same guy who went before the Nevada State Athletic Commission on the Gomi fight you know when he didn't want to be suspended and told them that he would never do it again.
It was a mistake and then you know he's bragging you know that's like I will grant you that I don't think that smoking pot is that of a big deal, I really don't. Now as far as it being illegal to be on pot while you are fighting, I can certainly understand why that is and that's the rules, but the whole point is that everyone knows what the rules are, you know what I mean?

It's like, if you can want to change the rules you can fight to change the rules and if the rules change, you know, that's fine. But these are the rules that you go by and what a lot of people don't seem to realize is that fighting is not a right, fighting is a privilege and being licensed to fight is a privilege, you know, it's not something that anyone can do because most people shouldn't be allowed to do it...
UPDATE: Loretta Hunt reports that Jesse Taylor has been submitted as a possible replacement if Diaz isn't licensed to compete:
Meanwhile, Jesse Taylor's name has been submitted for approval as a new opponent for Hieron, according to California State Athletic Commission Assistant Executive Officer Bill Douglas. Strikeforce CEO Scott Coker confirmed to Sherdog.com that Taylor is the only fighter that has been presented as a replacement at this time.

Nate needs to decide if he is a professional fighter or not. That’s really what this comes down to. I love “training” being the excuse for missing the test to begin with. “Sorry, I was too busy training for a fight that I won’t get to actually have if I don’t take the drug test”

Tompkins is a crap talker, but in his defense, what Diaz is doing is horrible. He is either ducking or is on drugs. Either way, Hieron has been through a lot these last few weeks to still be putting up with low level garbage like this.

The odd thing with this situation is that the CSAC already failed. Diaz is circumventing the system by getting the drug test a bit later than he should have gotten it.

MMAWeekly is basically saying that the fight is off and Taylor is in vs. Hieron because SF and CSAC have a disagreement on whether or not Diaz should be able to take the test. If the CSAC actually denies Diaz the ability to take the test, that’d be the first right thing they’ve done in a shitty situation.

I don’t have a problem with them giving him till today, but if they said today is the final deadline, that’s it.
This people aren’t up to the point of WADA testing where you always have to give them a list of where you’re going to be 24/7/365, so the excuse that he was in the mountains is semi-legitimate. But if he can’t show up after getting the weekend for notice, he shouldn’t be allowed to fight.

He has come through just fine for the promotion in the last few events. Every promotion employs a few bad apples and you have to take the bad with the good. They didn’t exactly put the card together banking on Diaz. His fight has gained importance as the other fights fell into the trash. I’m really not sure why Strikeforce management deserves to get bashed for this card?

Diaz’s license expired on July 25th, and because all fighters who have prior drug violations have to pass a test regarding the specific drug in order to get a new license, Diaz had to pass a test for marijuana before he could be licensed.

Everyone in here is automatically assuming that Nick is smoking pot again. The guy is late for his test! Does that make him guilty of something right off the bat?! Even if he DOES test positive for THC, it’s a DEPRESSANT. How can anyone argue that a depressant is a performance enhancing drug? It’s a joke. The main problem with these tests are that they only show that the substance HAS been present in the fighter’s system. It does not prove in any way that Diaz will be high at the time of the fight. Alcohol is way worse than marijuana, and fighters are allowed to get hammered drunk when they aren’t fighting. Don’t make much sense to me.

Nick Diaz, by not taking the test (for whatever reason), is screwing over himself, his opponent, the fans, and the promotion. And that sucks.

If the company you work for has a policy you don’t agree with, you CAN try to fight the policy, but until it’s officially changed, you abide by it. If Diaz is a professional fighter, he needs to abide by the rules laid down by his employer. If he fails to do so, the employer has the right to punish him.
So while I agree that weed probably won’t help you in a fight, and I personally think it should be legal, I do NOT think anything you said excuses Nicks behavior. He could spearhead the movement to legalize weed for all I care, as long as he meets his obligations to his employer, and to the fans who have paid money to see him.
This isn’t about legalizing pot or whether or not pot helps/hinders in an MMA fight. Don’t try to change the subject.

He needs a license to fight, and therefore ,since he chose to be a professional fighter, he needs to do whatever is necessary to get that license.
People give up things for their jobs. I can’t live anywhere that doesn’t have a biomedical facility nearby, surgeons can’t do anything that would jeopardize their hands, and in this case, a professional fighter can’t fail a drug test.
If he has a “legit” medical condition, then it’s up to him to make sure that the people prescribing the medicine for his condition have an agreement with the CSAC to avoid situations like this. Once again, this is NOT a matter of whether weed should be legal or not, it’s a matter of personal responsibility.

Secondly, everyone assumes it’s POT because he already tested positive before and he stated in a interview that he can beat the test using cleansers. Sure, he might just be late, but how can you expect people to actually not think he’s on weed right now.

Exactly. How can it not be pot? He talks to the CSAC, tells them about his agreement with Garcia. Asks for a legal opinion. They come back and say nope, sorry…you gotta pass a weed test. And…they don’t hear from him after that. He’s not just late for a test. He’s not even in contact with the CSAC or his promoter. 1+1=2 here.

Yes, but in order to fight, he needs to PASS A DRUG TEST.
So, since both scenarios (failing the drug test OR not taking the drug test ) end with him NOT PASSING A DRUG TEST, he receives the same treatment.
Again, we’re not looking at whether or not whether or not he smokes weed, we’re looking at the failed obligation to pass a drug test.

This fight is not happening because Diaz didnt want to take the test… he cycles off the weed on a certain schedule but he gone fucked up because he needed to take the test earlier than he thought.
So instead of taking the chance of getting caught and then not being able to fight for a whole year he just decided not to take the test. His people supported his decision not to take the test and risk getting banned for a minimum of a year.

In both instances the fighters were caught off guard by the test (not sure what Nick’ excuse is after seeing what happened with Barnett).
I’m inclined to believe CSAC probably knew both were cheating the test and used the loophole to their advantage. It doesn’t sound like CSAC sent a letter out 2 months prior to the license expiration, warning them of a looming test.

Their licenses both expired. There were no loopholes. They had to be tested to get their license back. You’re right about them not warning fighters, but it’s still the fighter’s fault…nothing proactive is being done by the commission in these cases.

Sure, he’s cheating the test, not MMA. Anyone at my place of work gets fired if weed shows up in a drug test. It’s a reality everyone is aware of even if there is a disagreement.

I guess the story is that Armando Garcia allowed him to just test for weed on fight night…because he has a legal medical perscription to use it. The new commissioner said that old agreement is out the window, so Diaz didn’t have enough time to cycle off before the test a week out from the fight. Seems like somebody could have figured that this was going to happen, or at least should have asked the CSAC if the old agreement that Diaz had with Garcia would still stand.
He fought Shamrock in CA on April 9th…what procedure was followed for that fight?

Diaz is smart to not take the test…it’s not his fault he has a legit condition and needs to smoke weed (many of us go through the same problem, its terrible and he’s an inspiration to us all)…
why risk suspension just to fight Jay Heiron for a meaningless title in the world of mma??? He could end up fighting on the Fedor card instead against probably a better opponent which would work out for him better (more viewers) and it’ll still probably be for the SF WW title whenever he fights next…
oh well, still wish he was fighting this weekend but I also wish he was back in the UFC and neither is happening (right now) so I’ll just enjoy waiting to see if Gina and Cyborg can make weight and I’ll listen to the SF conference calls again and laugh at how much a joke they are…

Diaz is taking a test to get a license, not a pre-fight or post-fight test. If he failed the test than he just wouldn’t get a license in California for a while. It’s kind of a loophole. If there was at least a 50% chance he would have passed, he should have taken the damn thing. If he was denied a license he still could have gotten one for the next Showtime event.

Being able to participate in the next event is questionable. Technically it’s up to CSAC’s discretion to allow Diaz to reapply for his license. A failed drug test doesn’t help his cause.

Why would they?
If he passes a drug test for the next event (outside of California I mean), and doesn’t say anything stupid like how he’s cheating the system, then an athletic commission that denies Diaz a license could be risking a lawsuit. He didn’t fail a drug test, he just didn’t show up to one. Yes we all know Diaz is probably a major-league pot-head, but without hard evidence of doping within the last year, there’s no legal standard by which another athletic commission could deny him a license.

actually it does work like that…
you wont be “suspended” but you wont get a license for a year and all the commissions in the states usually follow suit. so in essence it is a “suspension” without it being on your record.
The bottom line is Nick and his team decided it would be much better not taking this chance and simply fighting within the next few months than being shelved.

The other states’ respective athletic commissions are free to make their own decisions on this and their is no obligatory blanket ban, nor would he be penalized in any way for fighting oversees or in a place without an athletic commission. After Barnett was denied a license to fight, Nevada State Athletic Commission executive director Keith Kizer said, “Anyone can apply, but I do know how the Commissioners would vote on any specific application.”

First, Alistair Overeem dropped out of his title defense against Fabricio Werdum because he hurt his hand in a bar brawl. Then Joe Riggs suffered from a reaction to some medication and was unable to fight Nick Diaz for the open welterweight belt. Then, Josh Thomson pulled out of his lightweight title unification fight against Gilbert Melendez due to injury. Now, Nick Diaz has missed his drug test and will be replaced by Jesse Taylor. I was really looking foward to this card but I dont even know if I will be watching it.

According to Gracie, former CSAC Executive Officer Armando Garcia came to an agreement with the coach and fighter over a year ago that Diaz would be tested for marijuana, as well as all other non-approved substances, only on the nights of his scheduled bouts.
Gracie said Diaz has a legal medical prescription for marijuana to treat a hyperactivity disorder and that Garcia’s arrangement with the fighter allowed Diaz a two-week window to flush the drug out of his system.
